Our Keynote Speaker

Justice Lene Madsen

Justice Madsen was appointed to the Ontario Superior Court of Justice on October 18, 2016, and to the Court of Appeal for Ontario on April 30, 2024. She previously sat in Kitchener-Waterloo Superior Court, where she was the Local Administrative Judge as well as the Team Lead for the Unified Family Court. Prior to that she presided in the Unified Family Court in Hamilton, Ontario. Justice Madsen obtained her BA (Hons) from McGill University in 1992 and her LLB from Osgoode Hall Law School in 2002. She also holds a Master’s Degree in Environmental Studies (2000) and a Master’s Degree in Law (2012), both from York University. In addition, she holds a Graduate Diploma in Refugee and Migration Studies (2000), also from York University. Justice Madsen has authored a range of academic articles on issues related to family law and alternative dispute resolution. She was co-author of Epstein and Madsen’s This Week in Family Law for five years and co-author of McLeod’s Ontario Family Law Rules from 2020 - 2024. Prior to her appointment to the Superior Court, Justice Madsen was the principal of Bluewater Mediation, based in London, Ontario, where she was a mediator, arbitrator, and trainer in the alternative dispute resolution field. Prior to founding Bluewater Mediation, she practiced family law at Epstein Cole, LLP. Justice Madsen has lived, worked, and studied internationally, including in Scandinavia, the former Yugoslavia, South Asia, and East Africa. Her prior professional engagement includes work in the international development and international human rights contexts.

Keynote Speaker | Justice Lene Madsen | Empathy, Peacemaking, and the Gifts of the Mediator

Join Justice Madsen for an exploration of empathy – what it is, how we work with it, and its potential for peacemaking in and beyond the family mediation context. Drawing on literature from psychology, law medicine, international conflict resolution, Justice Madsen will discuss the promise – and the limits – of empathy in family dispute resolution, and beyond.

Plenary | Motivation: Understanding Why and How People Change

One of the most difficult challenges for ADR professionals is working with individuals who appear to be stuck in a state of recurring ambivalence, conflict or defensiveness who are often labelled as “difficult/high-conflict” or  “ungovernable”.  ADR professionals, in attempting to engage these clients, often use methods that include providing information, pushing, persuading or even attempting to “fix” clients in some acceptable manner to avoid resorting to termination, or referring the individuals to other ADR strategies. 

In this workshop participants will come to understand why and how people change and learn that alternative solutions to working with these clients is about knowing how to recognize and assess the individual’s Motivation to Change!

Screening for Mental Capacity & Undue Influence in Your Practice

Join us for a discussion led by mediator & arbitrator Julie Gill, estate litigator Ian Hull, and medical expert Dr. Shulman, where they highlight the complexities of incapacity and undue influence, as well as outline best practices when screening for, and addressing, these issues in your practice. 

This panel will provide you with an overview on the duty of practitioners to assess a clients’ mental capacity and a conversation on the various warning signs and red flags to look for when screening for incapacity and undue influence, leaving you better able to be assured that your clients’ intentions and wishes are protected, even in cases of diminished capacity.

This session will explore issues that arise in calculating income for support and equalization payments (including appropriate post-separation adjustments) for spouses who jointly own business and financial assets. “Family law professionals, including mediators, will increasingly be confronted with cases involving disputes over children’s gender identity and LGBTQ-related issues during separations and divorces” (Nicola Simpson, 2023). Join us for a panel discussion on how FDR professionals can help parents navigate these complex matters while adhering to the fundamental principle of the best interests of the child.
